These terms govern your use of the A-Comm.ai website and the free Business Discoverability Scanner ("the Service"). They are a binding agreement between you and A-Comm Inc. ("A-Comm," "we," "us"). If you do not agree, do not use the Service. The Service is a pre-launch offering and may change, expand, or be modified at any time.
By accessing the Service, you confirm that you are at least 18 years old, have the authority to bind the business you represent, and will use the Service only for lawful purposes. If you are using the Service on behalf of a business, "you" includes that business.
The Service is currently limited to a free Business Discoverability Scanner that analyzes whether a business website is structured for discoverability by ChatGPT. You provide a website URL, your name, and an email address. We email you a report based on automated analysis of publicly available information about the website.
We may also publish reference materials such as the Agentic Commerce Evidence Protocol (AEP) specification on our website. The AEP specification is licensed separately under the Apache License, Version 2.0; the terms of that license, not these Terms of Service, govern its use.
Other features described in our public materials — including dashboards, paid subscriptions, ongoing monitoring, additional AI platform coverage, fix execution, and platform integrations — are not currently available and form no part of the Service today. They are roadmap items, not commitments.
To run a scan you provide a name, an email address, and a website URL. You represent that you own or are authorized to request a scan of the website you submit, and that the email address is one you control. You are responsible for the accuracy of the information you provide.
We may rate-limit scans per email address, IP address, or website to keep the Service available and prevent abuse. We may decline to run a scan, refuse to deliver a report, or remove access at our discretion, including where we suspect misuse, automated abuse, or violation of these terms.
The Service today analyzes a single AI platform (ChatGPT). It does not measure, predict, or guarantee discoverability on any other AI platform.
Scan reports are based on automated analysis of publicly available information at the time of the scan and on heuristics that approximate how AI platforms structure and ingest discoverability data. Scan results are directional only. They are not a guarantee of any outcome, ranking, citation rate, traffic, revenue, or visibility on any AI platform. AI platform behavior is non-deterministic and AI platforms may change their requirements or behavior at any time. You are responsible for any decisions you make based on scan results.

The Service, including the website, scanner, scoring methodology, scan reports' presentation and analytical framework, software, designs, logos, and all related intellectual property, is owned by A-Comm and protected by U.S. and international law. We grant you a limited, revocable, non-transferable, non-exclusive license to access the Service for your internal business purposes only, subject to these terms. Nothing in these terms transfers any ownership to you.
You retain ownership of the information you submit (name, email, website URL). You grant A-Comm a worldwide, royalty-free license to use that information to operate, secure, and improve the Service, and to send you the report you requested.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. A-COMM DOES NOT WARRANT ANY OUTCOME, INCLUDING DISCOVERABILITY, RANKING, CITATION RATE, OR PERFORMANCE ON ANY AI PLATFORM.
The Service may rely on third-party data sources and APIs whose accuracy, availability, and behavior are outside our control. We disclaim responsibility for the accuracy or availability of third-party data.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, A-COMM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST DATA, LOST GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF A-COMM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). YOU AGREE THAT THIS CAP IS A REASONABLE ALLOCATION OF RISK GIVEN THE SERVICE IS PROVIDED FREE OF CHARGE.
Some jurisdictions do not allow limitations on certain warranties or damages, so portions of this section may not apply to you.
You will defend, indemnify, and hold harmless A-Comm and its officers, directors, employees, and agents from and against any third-party claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of the Service; your breach of these terms; your violation of any law or third-party right; or your submission of any website or information you were not authorized to submit.
We may modify, suspend, or discontinue the Service, in whole or in part, at any time without liability. We may update these terms; the "Last updated" date will reflect the most recent change. For material changes that increase your obligations, we will provide reasonable advance notice. Your continued use of the Service after the effective date constitutes acceptance of the updated terms.
We may suspend or terminate your access to the Service at any time, with or without notice, including for suspected violation of these terms. Sections that by their nature should survive (including Sections 5 through 10, 12, and 13) will survive any termination.
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Any dispute arising out of or related to the Service or these terms will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. To the extent permitted by law, you waive any right to a jury trial and any right to participate in a class action, collective action, or representative action.
Entire agreement. These terms, together with the Privacy Policy, constitute the entire agreement between you and A-Comm regarding the Service and supersede any prior agreements.
Severability. If any provision is held unenforceable, the remaining provisions will remain in full force and effect.
No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
Assignment. You may not assign these terms without our prior written consent. We may assign these terms in connection with a merger, acquisition, reorganization, or sale of assets.
Force majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control.
No third-party beneficiaries. These terms do not create any third-party beneficiary rights.
Export and sanctions. You represent that you are not located in, and will not access the Service from, any country subject to U.S. trade sanctions, and that you are not on any U.S. government list of prohibited or restricted parties.
Notices. Legal notices to A-Comm should be sent to legal@a-comm.ai. We may give you notice via the email address you provided when running a scan.
